TERMS & CONDITIONS

1. Introduction

a) These Terms and Conditions apply to all contracts for the supply of goods and services by MO Stone (referred to as “the Seller”) to any individual or company (referred to as “the Buyer”). All other terms and conditions are expressly excluded, including any terms proposed by the Buyer in purchase orders, confirmations, or other documents.

b) Any order placed with MO Stone shall constitute an offer by the Buyer to purchase goods and/or services strictly in accordance with these Terms and Conditions.

c) No variation or amendment to these Terms and Conditions shall be valid unless confirmed in writing and signed by an authorised representative of the Seller.

d) If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

e) Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights under the laws of the United Kingdom.


2. Supply of Stone

a) Stone is a natural material and may contain variations in colour, veining, markings, fissures, small holes, or surface features. Some imperfections may be naturally occurring or filled during processing.

i) Unless expressly agreed in writing, goods are not supplied by sample, and no guarantee is given that supplied materials will match any sample viewed.
ii) Subsequent orders of the same material may differ in colour and veining, as natural stone batches vary.

b) The selection of material supplied shall be at the discretion of the Seller unless otherwise agreed in writing.

c) Requests for material from a specific batch may incur additional costs if agreed in writing.

d) The provision of samples is at the Seller’s discretion and may be subject to a charge.

e) Tolerances:

  • Thickness variation: ±3mm

  • Length and width variation: ±1mm

  • Joint variation: ±2mm
    Joints exceeding one metre may exceed these tolerances at the Seller’s discretion.

f) Images shown on websites, brochures, or promotional material are for illustrative purposes only and should not be relied upon as an exact representation.


3. Performance of Stone

a) Natural stone is susceptible to staining and etching. While treatments may improve resistance, stone is not stain-proof and may react to acidic substances. Regular maintenance is strongly recommended.

b) The Buyer is responsible for determining suitability for the intended application. No performance warranties are provided unless expressly agreed in writing.

c) Professional installation and correct application of treatments are essential to ensure performance.

d) The Buyer is responsible for ensuring that all substrates and supporting structures are suitable. Any advice provided by the Seller is general in nature only.


4. Quotations

a) Quotations are valid for 30 days unless stated otherwise.

b) The Buyer is responsible for verifying measurements and quantities. The Seller accepts no liability for shortages or excess material.

c) Additional visits due to changes in requirements may incur charges.

d) Lead times are estimates only and commence upon receipt of final instructions and deposit.

e) Changes to agreed dates may affect delivery or installation schedules.

f) All drawings must be accurate, clear, and fully dimensioned. The Seller is not liable for errors arising from incorrect information provided by the Buyer.


5. Delivery

a) Delivery dates are estimates and not of the essence.

b) Deliveries are made to the roadside only, at the nearest safe point.

c) The Buyer must inspect goods upon delivery. Any damage, shortages, or defects must be noted on the delivery note and reported within 48 hours, supported by photographs.

d) Deliveries outside the UK must be agreed in writing.

e) The Seller is not responsible for deliveries carried out by independent carriers unless agreed in writing.

f) Goods should be stored vertically on a protected surface after delivery.


6. Risk, Ownership & Liability

a) Risk passes to the Buyer upon delivery, collection, or attempted delivery.

b) Ownership of goods remains with the Seller until full payment, including VAT, has been received.

c) Transit insurance for independent carriers is the responsibility of the Buyer unless agreed otherwise.


7. Limitation of Liability

a) Claims relating to stone supply will not be accepted after installation.

b) If valid defects are reported within 48 hours, the Seller may repair, replace, or rectify at its discretion.

c) The Seller shall not be liable for indirect, consequential, or economic losses.

d) Where MO Stone supplies and installs worktops:
i) The Buyer must comply with the Template & Installation Policy.
ii) Installation is guaranteed for 12 months from completion.


8. Terms of Payment

a) A 50% deposit is required prior to templating unless otherwise agreed in writing.

b) The balance must be paid in full before delivery, collection, or installation.

c) Staged payments may apply for part deliveries if agreed in writing.

d) Payment methods include card, bank transfer, or cleared cheque.

e) Account customers must settle invoices within 30 days of month-end.


9. Templates & Cutting Lists

a) Templates and cutting lists must be approved and signed by the Buyer or their authorised representative prior to manufacture.

b) Drawings must be carefully checked by the Buyer.

c) Changes to specifications may result in additional charges.

Failure to comply with the template or installation process may result in extra visits and costs.


10. Dispute Resolution

a) These Terms and Conditions are governed by the laws of the United Kingdom.

b) Where applicable, the Housing Grants, Construction and Regeneration Act 1996 Part II shall apply.

c) Either party may refer disputes to adjudication in accordance with the Act.


11. Cancellations

a) Cancellation requests must be submitted in writing as soon as possible.

b) Deposits are non-refundable unless otherwise agreed in writing.


12. Cancellation Information

a) Late cancellations for stock items may incur charges.

b) Cancellations of non-stock items after materials have been ordered will incur charges.

c) Cancellation notices must be sent in writing to:
